1. Acceptance of Terms

By accessing or using IVY, Me! (the "Service"), operated at ivyme.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are under 18, your parent or guardian must agree to these Terms on your behalf. We reserve the right to update these Terms at any time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of Service

IVY, Me! is an AI-powered SAT tutoring platform that provides personalized, adaptive test preparation. The Service includes diagnostic assessments, practice questions, AI-driven tutoring sessions with specialist agents (math, reading & writing, assessment, and study planning), personalized study plans, progress tracking, score predictions, and mock tests.

The Service uses artificial intelligence models, including Claude by Anthropic and Google Gemini, to provide tutoring. All tutoring interactions are with AI, not human tutors. The Service is designed to supplement, not replace, traditional educational resources.

3. Eligibility & User Accounts

• You must be at least 13 years old to create an account. Users between 13 and 18 must have parental or guardian consent. By creating an account, you represent that you meet these age requirements.
• Account creation is handled through Google OAuth. You are responsible for maintaining the security of your Google account credentials.
• Each person may maintain only one account. Sharing accounts is prohibited.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and to keep your account information up to date.

4. AI-Generated Content

All tutoring content provided by IVY, Me! is generated by artificial intelligence. By using the Service, you acknowledge and agree to the following:

• Potential for Errors: All tutoring content is generated by AI and may contain errors, inaccuracies, or incomplete information. AI systems are not perfect and can occasionally produce incorrect explanations or solutions.
• Supplemental Resource: AI tutoring is supplemental and is not a replacement for professional education, human tutoring, or formal academic instruction. You should verify important information independently.
• No Guarantees: We make no guarantee of the accuracy, completeness, or reliability of AI-generated responses. We do not guarantee any SAT score improvements — results vary based on individual effort, baseline knowledge, study consistency, and many other factors.
• AI Limitations: AI-generated content may reflect limitations or biases present in the AI models' training data. We continually work to improve accuracy and reduce biases, but cannot eliminate them entirely.
• Clear Disclosure: The Service clearly discloses when you are interacting with AI. All tutoring sessions are conducted by AI agents, not human tutors.

5. Study Groups

IVY, Me! offers a study groups feature ("Friends Plan") that allows users to study together and share progress:

• Study groups allow multiple users to form groups of 3 or more members to study together and share progress data.
• Group owners can invite members via email and revoke pending invitations at any time.
• Members can leave groups voluntarily, subject to subscription requirements (e.g., maintaining minimum group size for Friends Plan pricing).
• Users are responsible for their conduct within study groups and for the appropriateness of any interactions with group members.
• Shared progress data (such as study streaks, topic mastery, and practice scores) is visible to all members of the group.

6. Subscription & Payments

• Free Tier: All users have access to a free tier that includes a diagnostic assessment, personalized study plan, 3 practice questions per day, and basic progress tracking. No credit card is required.
• Pro Plan: The Pro plan is $20/month, billed monthly. This includes unlimited AI tutoring, practice questions, mock tests, and all platform features.
• Friends Plan: Groups of 3 or more can subscribe at $15/month per person, billed monthly to each member.
• Prepaid Option: A 6-month prepaid plan is available for $99 (approximately $16.50/month).
• Referral Codes: We may offer referral codes that grant promotional access to the Service. Referral codes are subject to terms specified at the time of issuance and may be revoked at our discretion.
• Billing: All payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled.
• Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access until the end of your current billing period.
• Refunds: Monthly subscription payments are non-refundable for the current billing period. Prepaid plans may be refunded on a pro-rata basis for unused full months if requested within the first 30 days.

7. Acceptable Use

When using the Service, you agree not to:

• Use the Service to cheat on actual SAT exams or any other standardized tests. IVY, Me! is a preparation tool, and using it during a live exam violates College Board policies and these Terms.
• Share your account credentials with others or allow others to access the Service through your account.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service, including our AI models, algorithms, or tutoring logic.
• Use automated scripts, bots, or scrapers to access the Service or extract content.
• Upload, transmit, or distribute any harmful, offensive, or unlawful content through the Service.
• Attempt to circumvent any security measures or access controls of the Service.
• Use the Service in any way that could damage, disable, or impair its functionality.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the IVY, Me! brand, logo, AI tutoring system, question databases, study plan algorithms, user interface design, and documentation — are owned by IVY, Me! and are protected by copyright, trademark, and other intellectual property laws.

SAT is a registered trademark of the College Board, which is not affiliated with and does not endorse IVY, Me!.

You retain ownership of any personal data and learning content you create through the Service (such as notes or custom study preferences). By using the Service, you grant us a limited license to use your learning interaction data to improve our tutoring algorithms, in accordance with our Privacy Policy.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference. Please review it to understand our privacy practices.

10. Disclaimers

• No Score Guarantee: While IVY, Me! is designed to help you improve your SAT score, we do not guarantee any specific score outcome. Individual results vary based on effort, baseline knowledge, study consistency, and many other factors.
• Educational Supplement: The Service is an educational tool intended to supplement your SAT preparation. It is not a replacement for formal education, school coursework, or professional academic advising.
• AI Limitations: Our AI tutors are powered by large language models that, while sophisticated, are not infallible. AI-generated content may contain errors, inaccuracies, incomplete information, or reflect biases in training data. The Service does not guarantee the accuracy, completeness, or reliability of any AI-generated responses. Users should verify important information independently and understand that AI tutoring is supplemental, not a replacement for human instruction.
• "As Is" Provision: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, IVY, Me! and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or related to your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable. You may terminate your account at any time by contacting us at support@ivyme.ai or through your account settings.

Upon termination, your data will be handled in accordance with our Privacy Policy and applicable data retention requirements.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in Delaware. You agree to submit to the personal jurisdiction of such courts.

For users under 18, any arbitration or legal proceedings must include the user's parent or guardian.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify users by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification to the address associated with your account.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.
